By accessing or using the Site, you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Site. We may update these Terms at any time; the “Effective date” above will change accordingly.

2. Services & Scope

The Site provides information about photography services (e.g., weddings, family, headshots, maternity, beauty/ intimate, graduation, seasonal sessions) in South Florida. Online booking, inquiries, and payment links may be offered via third-party providers (e.g., Stripe).

Note: Session deliverables, rescheduling, cancellations, usage rights, and model releases are governed by a separate client agreement signed at booking. If any conflict exists, the client agreement controls.

3. Pricing & Payments

Displayed prices (including “Starting at” prices) are subject to change until confirmed at checkout or in a written quote. Payments processed via third parties (e.g., Stripe) are subject to their terms and fees. Taxes, travel fees outside Broward/Palm Beach, rush edits, prints, or add-ons may apply.

4. Booking, Rescheduling & Cancellations

Unless stated otherwise in your client agreement:

Retainer/Booking Fee: a non-refundable retainer may be required to reserve the date.

Rescheduling: no fee with 48 hours’ notice (subject to availability).

Cancellations/No-shows: may forfeit the retainer and any costs incurred.

Weather, safety, or unforeseen events: we may reschedule at our discretion.

5. User Conduct

You agree not to misuse the Site, interfere with security, or upload unlawful content. You will not use the Site to infringe third-party rights or violate any applicable law.

6. Intellectual Property

All content on the Site (texts, images, branding) is owned by us or licensed to us and is protected by IP laws. You receive a limited, non-exclusive, non-transferable license to view the Site for personal, non-commercial use. No reproduction, distribution, or derivative works without written consent.

7. Photo Usage & Model Releases

Client image licensing, personal use rights, social media usage, and portfolio permissions are defined in the client agreement/model release executed per project. We may showcase work in our portfolio unless the client agreement states otherwise.

8. Testimonials & Reviews

Testimonials may reflect individual experiences and are not guarantees. If you submit a review, you grant us a non-exclusive right to display, edit for clarity, and use it for marketing, in accordance with our Privacy Policy.

9. Third-Party Links & Tools

Third-party links (e.g., payment, scheduling, maps, social media) are provided “as is.” We are not responsible for their content, practices, or availability.

10. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, NOR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES.

You agree to indemnify and hold us harmless from claims arising out of your use of the Site, your content, or your violation of these Terms or applicable law.

14. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflicts of law. Any dispute will be resolved by binding arbitration in Broward County, Florida under AAA rules. Class actions are waived. You and we agree to individual claims only.
