# PHOTOGRAPHY SERVICES TERMS

## IMPORTANT STUDIO LOCATION NOTICE


Patricia Monteiro Photography’s studio is located at:

Before booking and completing payment, the client is responsible for reviewing the studio address and confirming that they are able and willing to travel to this location on the scheduled date and time.


The client acknowledges that the studio is located in *Oakland Park, Florida*, and that the client’s distance from the studio, travel time, traffic conditions, transportation costs, unfamiliarity with the area, or failure to review the address before purchasing do not constitute valid grounds for cancellation, refund, chargeback, or payment dispute.


The client is responsible for planning sufficient travel time and arriving at the studio at the scheduled appointment time.


Unless a different location is expressly stated in the selected package or confirmed in writing by Patricia Monteiro Photography, the photography service will take place at the studio address listed above.




By purchasing or booking a photography service from Patricia Monteiro Photography, the client acknowledges that they have reviewed and accepted the studio location and have read, understood, and agreed to the following terms.




## 1. Booking and Confirmation


A photography session or event date is not considered confirmed until the required payment, retainer, or full package price has been successfully received.


Submitting a form, requesting a date, or beginning the checkout process does not guarantee availability.


Patricia Monteiro Photography may contact the client to confirm the date, time, location, selected package, number of participants, and any additional requirements.


Unless otherwise confirmed in writing, studio sessions will be held at:

## 2. Payments


The client agrees to pay the price displayed during checkout, together with any applicable taxes, travel fees, location fees, permit fees, overtime charges, additional-image fees, or other services selected by the client.


Unless otherwise stated in writing, any booking retainer or reservation fee is non-refundable because it reserves the photographer’s time and prevents the selected date from being offered to another client.


Any remaining balance must be paid by the deadline provided by Patricia Monteiro Photography. Photography services and final images may be withheld until all outstanding amounts have been paid.




## 3. Cancellations


If the client cancels the booking, any retainer or reservation fee already paid will not be refunded.

Payments exceeding the retainer may be refundable only when expressly stated in the applicable package description or confirmed in writing by Patricia Monteiro Photography.

Failure to attend the session without prior notice will be treated as a client cancellation and may result in the loss of all payments made.

Cancellation based on the client’s distance from the studio, travel time, traffic, transportation difficulties, transportation costs, unfamiliarity with the location, or failure to review the studio address before purchasing will be treated as a client cancellation and will not create a right to a refund.



## 4. Rescheduling


A client may request to reschedule by providing reasonable advance notice.


Rescheduling is subject to the photographer’s availability and is not guaranteed. A rescheduling fee may apply, particularly when the request is made close to the scheduled session.


Unless otherwise agreed in writing, the client may reschedule a booking only once. Additional rescheduling requests may require a new booking and payment.


Traffic, travel distance, transportation costs, or predictable transportation difficulties do not automatically entitle the client to free rescheduling.



## 5. Weather and Outdoor Sessions


For outdoor sessions, weather, lighting, accessibility, safety, and location conditions may affect the session.


The photographer will determine whether conditions are reasonably suitable for photography. When unsafe or unsuitable weather prevents the session, Patricia Monteiro Photography may offer a new available date.


Clouds, wind, temperature changes, natural lighting variations, crowds, temporary construction, or other ordinary outdoor conditions do not automatically entitle the client to a refund.



## 6. Late Arrival


The client is responsible for arriving on time and ready for the session.


The client should consider the distance to the studio, expected traffic, parking, weather, and other travel conditions when planning their arrival.


Late arrival may reduce the available photography time without reducing the package price. The photographer is not required to extend the session when doing so would interfere with another appointment or commitment.


Significant delays may be treated as a missed session.



## 7. Client Responsibilities


The client is responsible for:


* Providing accurate contact and booking information;

* Reviewing the selected package before purchasing;

* Reviewing and confirming the studio address before completing payment;

* Planning transportation and sufficient travel time;

* Arriving on time;

* Obtaining any necessary permissions for privately owned locations;

* Paying parking, admission, permit, venue, or access fees unless otherwise stated;

* Supervising children, pets, and other participants;

* Informing the photographer in advance about accessibility needs, allergies, medical concerns, or conditions that may affect the session;

* Ensuring that all participants understand the session arrangements.



A parent or legal guardian must accompany and supervise minors unless otherwise agreed in writing.



## 8. Safety and Conduct


Patricia Monteiro Photography may stop, relocate, postpone, or cancel a session when conditions are unsafe, unlawful, abusive, threatening, or damaging to people, animals, property, or equipment.


The photographer may refuse requests involving dangerous conduct, illegal activity, harassment, discrimination, or inappropriate treatment of any participant.


Cancellation resulting from the client’s unsafe, abusive, or unlawful conduct will not entitle the client to a refund.



## 9. Artistic Style and Creative Discretion


The client acknowledges that photography is a creative service.


By booking Patricia Monteiro Photography, the client accepts the photographer’s portfolio, visual style, posing direction, lighting, composition, image selection, color treatment, and editing approach.


The photographer retains professional and artistic discretion regarding which images are selected, edited, and delivered.


Differences in lighting, location, weather, clothing, physical appearance, participant cooperation, or other circumstances may affect the final result. No specific pose, background, expression, or image can be guaranteed unless expressly agreed in writing.



## 10. Image Selection


Depending on the purchased package, the client may receive a proofing gallery or another method for selecting favorite images.


The client must complete their selection within the period communicated by Patricia Monteiro Photography. Delays in selecting images may delay final delivery.


Additional photographs beyond the number included in the package may be purchased at the price presented to the client.


Unselected images are not included unless otherwise stated.



## 11. Editing and Retouching


Standard professional editing may include adjustments to exposure, color, contrast, cropping, composition, and minor appearance details consistent with the photographer’s style.


Extensive retouching, body modification, object removal, background replacement, clothing alteration, composite work, or other substantial changes are not included unless specifically described in the package or purchased separately.


RAW files, unedited files, rejected images, test shots, duplicate images, and working files are not delivered.



## 12. Delivery


Images will be delivered according to the method and estimated timeframe stated in the purchased package or communicated to the client.


Delivery dates are estimates and may be affected by workload, image volume, client selection delays, technical issues, holidays, emergencies, or events beyond the photographer’s reasonable control.


A delay does not automatically entitle the client to a refund.


The client is responsible for downloading and safely backing up the delivered files before the gallery or download link expires.


Patricia Monteiro Photography does not guarantee permanent online storage of client galleries or photographs.



## 13. Copyright and Personal Use License


Patricia Monteiro Photography retains the copyright and ownership of all photographs unless a separate written copyright assignment has been signed.


After full payment, the client receives a limited, non-exclusive, non-transferable license to download, display, share, and print the delivered photographs for personal use.


The client may not sell, license, commercially exploit, submit for commercial publication, materially alter, apply filters to, claim authorship of, or remove copyright information from the photographs without prior written authorization.


Commercial, advertising, corporate, editorial, or promotional use may require a separate license.



## 14. Social Media Sharing


The client may share delivered photographs on personal social media accounts, provided that the images are not materially altered or used for commercial purposes.


Crediting Patricia Monteiro Photography is appreciated whenever reasonably possible.


Screenshots, photographs of proofs, watermarked previews, or images that have not been purchased or delivered may not be published.



## 15. Publication and Model Release


Purchasing photography services does not automatically require the client to authorize public use of their likeness.


Any permission allowing Patricia Monteiro Photography to publish identifiable client images in a portfolio, website, social media account, advertisement, competition, educational material, or promotional publication should be obtained through a separate model-release authorization.


Declining an optional model release will not affect the photography service purchased by the client.



## 16. Children and Minors


A parent or legal guardian must authorize photography involving a minor.


The adult making the booking represents that they have the legal authority to authorize the minor’s participation or that they have obtained the necessary permission from the minor’s parent or legal guardian.


Authorization to photograph a minor does not automatically authorize public or promotional use of the minor’s images.



## 17. Equipment Failure, Illness, and Events Beyond Reasonable Control


If Patricia Monteiro Photography cannot perform the service because of serious illness, emergency, equipment failure, accident, severe weather, government restriction, venue closure, or another circumstance beyond reasonable control, the photographer may offer:


* A rescheduled date;

* A qualified replacement photographer, when appropriate and approved;

* A service credit; or

* A refund of amounts paid for services that were not provided.



To the extent permitted by law, Patricia Monteiro Photography’s total liability will not exceed the amount paid by the client for the affected photography service.



## 18. Digital Files, Printing, and Third-Party Services


Colors and image appearance may vary between screens, devices, printers, paper types, laboratories, and third-party platforms.


Patricia Monteiro Photography is not responsible for quality issues caused by unauthorized editing, screenshots, compressed downloads, social media processing, client-selected printers, or third-party printing services.


For the best results, clients should use the file type and printing recommendations provided by the photographer.



## 19. Privacy and Communications


The client authorizes Patricia Monteiro Photography to use the contact information provided to process the booking, collect payment, communicate about the session, deliver photographs, provide customer support, and maintain necessary business records.


Transactional communications relating to the purchase or session are part of the service and are not promotional marketing messages.


Personal information will be handled in accordance with the website’s Privacy Policy and applicable law.



## 20. Chargebacks and Payment Disputes


Before initiating a chargeback or payment dispute, the client agrees to contact Patricia Monteiro Photography and provide a reasonable opportunity to investigate and resolve the issue.


The client acknowledges that the studio address was clearly disclosed before purchase. A chargeback based on distance, travel time, transportation costs, traffic, unfamiliarity with the location, or failure to review the disclosed address may be challenged using the booking records, acceptance records, studio-location disclosure, correspondence, and payment documentation.


Fraudulent or improper chargebacks may be challenged using the booking information, acceptance records, correspondence, delivery records, and other relevant evidence.


Nothing in this section limits any non-waivable consumer right available under applicable law.



## 21. No Guarantee of Subjective Satisfaction


Patricia Monteiro Photography will perform the services with reasonable professional care and in accordance with the selected package.


Because photography involves artistic judgment and subjective preferences, the client’s personal dissatisfaction with poses, facial expressions, appearance, weather, location conditions, or the photographer’s established editing style does not, by itself, constitute a failure to provide the service.



## 22. Governing Law


These terms will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.


Any dispute will be handled in a court of competent jurisdiction serving the area in Florida where Patricia Monteiro Photography principally operates, unless applicable consumer law requires otherwise.



## 23. Severability


If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.



## 24. Entire Agreement


These terms, the selected package description, the checkout information, the Privacy Policy, and any written agreement or written confirmation issued by Patricia Monteiro Photography constitute the agreement between the client and the photographer.


In the event of a conflict, a separately signed photography agreement or a specific written package agreement will control.



## 25. Acceptance


By checking the acceptance box and completing the purchase, the client confirms that:


* They are at least 18 years old and legally able to enter into this agreement;

* The information provided is accurate;

* They reviewed the selected photography package;

* They reviewed and accepted the studio location at 3900 NE 18th Ave, Oakland Park, FL 33334, USA;

* They are responsible for determining the distance, travel time, transportation arrangements, and costs necessary to attend the session;

* They understand that distance from the studio or failure to review the address does not create a right to cancellation or refund;

* They understand the booking, payment, cancellation, rescheduling, editing, delivery, and copyright policies;

* They agree to these Photography Services Terms and the Privacy Policy;

* Their electronic acceptance has the same effect as a handwritten signature to the extent permitted by applicable law.
